This website, located at www.austriavacanze.com is owned and operated by Austriavacanze – Tourism Image SA (hereinafter also "Austriavacanze") that is an online travel agency  “Destination Management Company” under Swiss law, with headquarters in Via Alessandro Volta 2° - CH6830 Chiasso (Svizzera), which recognizes the importance of protecting its Users privacy and rights and takes seriously the commitment of complying with the personal data protection and security rules in order to ensure a safe, controlled and confidential navigation.

The information included in these Terms and Conditions can be modified in accordance with eventual changes of the applicable law in order to ensure full compliance.

We encourage our Users to carefully read the applied rules for collecting and processing personal data thus continuing to provide a satisfactory service.

The Terms of this privacy policy, accordingly with the legislation on personal data protection, describe the management and treatment methods used on personal data from: users who check and use Austriavacanze, and any third parties on whose behalf the booking is made by a User of Austriavacanze.

The User is obliged to provide accurate, true and updated personal information in order to create and maintain the contractual relationship with the Owner and to proceed with purchasing the selected tourist service/s and/or package/s in an appropriate way. The User agrees to provide true, correct and up to date personal information, otherwise, Austriavacanze will be unable to provide the required services.

The data controllers are both Austriavacanze (hereinafter, "Austriavacanze" or "Owner") and the partner companies with a linkage and controlling relationship (hereinafter, the "Holders").

We inform you that personal data is stored and processed by Austriavacanze  in the manner and for the purposes listed below, according to current privacy law. The personal data from the User and any third parties on whose behalf the booking is made by a User of Austriavacanze are collected by: the compilation of the online registration form through Austriavacanze’s website or by telephone. Data: such as name, surname, address, e-mail address, telephone number, etc. are necessary to select and purchase the desired flight, hotel or tourist service/s, and for the additional purposes set out in these Terms and Conditions, the computer systems and software procedures used to operate Austriavacanze during a normal operation as an implicit result of using internet communication protocols. This information is not meant to be associated with any identified User whose nature could be identified by other Users through processing and associating data held by third parties. This category of data includes IP addresses or domain names of computers used by users who connect to the website, the URI (Uniform Resource Identifier) of the requested resources, the time of the request, the method used to submit the request to the server, the size of the file obtained in reply, the numerical code indicating the status of the server response (confirmed, error, etc.) and any other parameters regarding the operating system and computer environment of the User. These data are used only to obtain anonymous statistics related to the website navigation and to check its correct functioning. The data could be used to ascertain responsibility in case of hypothetical computer crimes against the Austriavacanze through the use of cookies. Cookies are information, which often contain anonymous unique identifier, that is sent to your browser from a web server which is then stored on the user's computer hard drive. Cookies reads and recognizes the same website that sent in the case of successive links. Austriavacanze may use cookies to store and sometimes track information provided by Users in order to provide a better service to the Users themselves

The data obtained from cookies will be used by the Owner, either directly or through collaborating companies, in order to ensure a simpler, straightforward and quick access and use of the Service and a simpler website navigation. As well as for marketing purposes related to the Owner’s services. The data which are not collected directly from the Users will be exclusively used for website traffic statistical purposes and not associated with the individual User.

The reception of cookies used on this Austriavacanze can be stopped at any time by the User by changing the settings of your browser.Users personal data are processed by manual and automatic means to achieve the purpose for which they have been collected and communicated and to guarantee security and privacy, as well as to prevent unauthorized access, until the purpose for which they were collected has been achieved. Data processing will take place at the registered office and operations of the Holders and at Austriavacanze’s server located in Amazon server, as well as from individuals to whom the information may be disclosed.

The personal data provided by Users are used, apart from what has already been specified for navigation data, for the following purposes:

-Collection, storage and/or processing the establishment and operational and administrative management of the contract related to the Service;

-Supplying travel service/s booked by the User;

-Using data to carry out communications related to the contractual relationship performance via email, pop ups, telephone or SMS;

-Comply with legal obligations;

-Collection, storage and processing of data to perform statistical analysis in an anonymous and/or aggregate way;

-Sending via email advertising material regarding products and/or services which are similar or related to the Service or products offered on the platform, except expressed denial of the User;

-Sending by mail, telephone, mail, SMS, MMS or apps in general all commercial offers related to products offered by the Owners themselves or by their commercial Partners which operate in the tourist, communication, media, entertainment, prior express consent of the User, without prejudice to what described in the paragraph E. Failure to provide personal information may result in the inability for the User to achieve the required performance on the purposes referred to in points A) and B) of this Article and the inability of the owner to provide the service correctly and fulfil their contractual obligations under the Terms and Conditions. The processing of such data, for the purposes mentioned in the paragraphs A, B, C, D, E and F of this Article, does not involve a request for consent. Failure to provide the information or the lack of consent by the User for this purpose will mean that, subject to paragraph E, the Holders will not send the User commercial offers referred to in paragraph F of this Article.

The Holder is committed to ensuring that the personal information of which it becomes aware will not be disclosed and will be treated with appropriate procedures to ensure the security and confidentiality, as well as to prevent unauthorized access to the data. Personal data and information provided by users may be disclosed , for the purposes described above, to the following categories of people: employees and/or collaborators who carry out support and consulting tasks for the Owner in areas such as Product Administration, Legal, Customer Care, Information Systems, as well as in charge of maintenance of the corporate network and the hardware and software in use airlines, hotels, car rental companies, insurance companies, tour operators and all other parties to which the transmission is necessary for the execution of the contract. Please note that airlines are now required to allow customs and border authorities to access passengers flight data as per new laws introduced in the US and other countries. Therefore, the User and his journeys information gathered from the same will be communicated to the competent authorities of the countries included in the itinerary of the User journey, if so required by the rules of the industry individuals who are authorized to access the data is recognized by law or by the competent authority individuals delegated and/or appointed by the Owners to carry out activities related to the supply of the Service with particular reference to the data collected in relation to insurance products, Austriavacanze shall ensure that (a) only the necessary data for the preparation of an offering are collected

Each User may exercise, by written request to the Owner, the following rights:

(a) obtain confirmation from the Controller of the existence of his personal data;

(b) gain acknowledgement of the data origins, purposes and methods of treatment, the logic applied in case of treatment by electronic means;

(c) obtaining the identity of the Owner and the responsible for the processing, if appointed;

(d) become aware of the individuals or categories of people to whom personal data may be communicated or who can know about them as representative managers or agents of the appointed State;

(e) the cancellation, transformation into anonymous form or blocking of data processed unlawfully, as well as updating, rectification or, where interested therein, integration of data and

(f) a declaration that operations referred to in point

(g) have been made known, including their contents, to those to whom the data were communicated or disseminated, except where such action is impossible or involves a disproportionate employment of means on the protected right;

(h) denying full or partial treatment, for legitimate reasons

(i) denying treatment for sending of advertising materials or direct selling or carrying out market research or commercial communication purposes.

The User also has the right, by express request via email, to obtain the correction or cancellation of any personal data which is inaccurate, to an extent permitted by the applied law.

The User can also follow a simple procedure to no longer receive marketing offers and promotions via e-mail from the Holders, in addition to the rights set forth above, by activating the link "unsubscribe" which is available in all commercial communications sent by the Holders.

 

2. SELECTION OF APPLICABLE LAW AND EXCLUSIVE JURISDICTION

The present Terms and Conditions and the relationship between the User and Austriavacanze are governed, to the extent permitted by applicable regulations, by the Swiss law. The involved parties agree that the resolution of any disputes that may arise between them shall be brought before the ordinary courts of Austriavacanze – Tourism Image SA headquarters, to the extent permitted by applicable law and international agreements. Austriavacanze also reserves the right to bring the User before the competent courts at the domicile of the User.
